What FPE can a muzzleloading pistol…

with a 6″ barrel of .40 caliber using 40gr of black powder deliver? I ask because in MD, that is acceptable for hunting bear. Meanwhile an air rifle needs to make 1200FPE. I suspect the pistol described above tops out at 350FPE but I don’t know.
