New Jersey Gun Law and Talon SS

I just purchased a Talon SS from Pyramid Air which was delivered to a firearms dealer in NJ recently. When I went to pickup the rifle I was told it was illegal in NJ and I had to exchange the rifle. According to the dealer the rifle is considered a sawed-off-shotgun due to it’s barrel lenngth. Any shotgun with a barrel length under 18 inches or rifle with a barrel lenth under 16 inches is considered a sawed-off-shotgun which is illegal in NJ. In NJ all BB\Pellet airguns atre considered a firearm. Barrel length is measured from breach to muzzle.

As the dealer said he recently discovered this through research can anyone verify or deny this law?

Does anyone own a Talon SS in NJ?

Considering this law as valid. What would be my best option as an exchange? I plan on using only in back yard for target and plinking. I had ordered a .177. Pyramid Air mentioned possibly ordering a larger barrel. I would have to see if the dealer is willing to replace the barrel.

That just does not make any sense, either it’s just pure stupidity or they might have meant LARGER than 3/8″.

Actually it does, at least it might. Seems to me the idea is to allow paintball guns (which would otherwise be prohibitied with other airguns).

The guys that do this are not really stupid or idiots, evil perhaps, but they have a plan. And they pool their skills to reach their goal. Dismissing them as idiots will get us the same sort of gun laws so widely enjoyed in the EU.

So true. So True. Everytime I bring out the airgun, I’m made to feel like some overzealous gun toting postal clerk at the mercy of any regular cop or the environmental police.

Damn I need to buy some land so I can drink some beers, grill a steak and shoot my gun. Just peace, fun and relaxation.

Discretion is why I bought a Talon SS. It can be broken down and packed away and it doen’t make that much noise. But if people happen to see it they think you are a sniper terrorist or something.

Alot of the confusion stems from federal laws as opposed to state laws.

Federal does not regulate airguns, but states are free to call an airgun a “firearm”.

If you look hard enough, theres a law against anything (especially airguns).

Every time I take out my air gun, I tell the wife to expect a call for bail money!! Seriously!!!

My state is very gun “unfriendly”.
I pack my airgun just like it was a firearm, cased, disassembled, unloaded, and no ammo in the cab of my truck.

I try to be as responsable and as descrete as I can so there are no “incidents” to attract attention. If theres anyone within a half mile of me, I pack up and go home.

Lets all move to texas or alaska!

Hearing about this kind of restriction in NJ completely nauseates me… it’s a single shot AIRGUN. I thought it was our constitutional right to keep and bear arms. Not to mention airguns

It’s also my understanding that one needs a permit ($$) to own an airgun in Jersey.

No they don’t. They say that you can’t silence a fire arm. Federal law, AFT, and Congress have forbidden any federal, state of local government from classifying any air gun as a fire arm. but the battle would bb long and expensive. Best let the big boys handle this one.

It is perfectly legal to have a sound deadening device on an air gun that is not readily adaptable to a fire arm with out modification.

Until recently any device that could used to silence a fire are was illegal. That is until it was challenged in court and shown that just about every swinging dick in the U.S. was then a felon. Own a Pillow, lawn more muffler, plastic coke bottle, Water Mellon, steel pipe? Any of these can be used to silence a fire arm if only for one shot. The law only requires one shot to be fired, and the sound to be reduced by 1db for it to be illegal. They added the without modification last year.

Hell, a bic pen is illegal in J. by the definition given here. They make a killer spit ball gun! But wait, you could hurt someones eye with those spit balls, and the bbl. is way under the legal limit!!! 😈 Better go and turn in all the drinking straws to the left wingers while we’re at it!

And for God’s sake, don’t even let any of those fuckers know that that extended frame is in all intents and purposes a SILENCER!

And these people work in a gun store and don’t know the difference between a rifle and a shot gun? A Air Rifle no less? Un-Friggin believable!!! This country is going to hell in a little pink purse!!!

Thanks, Megatron, but energy is not the issue here, at least as I understand it. It’s barrel length. The firearms law intended to prevent folks from sawing off a rifle barrel (and usually the stock as well) to make a concelable gun is being applied.

Energy is an issue in Canada like in the UK and most of the EU, but not here. Some states ban airguns, some ban by caliber, but if allowed there are no energy limits……yet.

LIke I said before, I think that due to the way the barrel length is measured, a Talon with a 12 inch barrel ‘counts’ as an 18 incher….legal to own. In a fun turn of events, if the owner went to get a ‘other dangerous weapon’ permit (needed for sawed off rifles and shotguns amongst others) for an airgun the Alcohol, Tobacco and Firearms guys would no doubt take his money and throw him out…..after they stopped laughing.

Sorry if I am wrong as I don know the laws in USA, but, I think that this could be reffered to the energy produces by the pellet. In fact in England the maximum allowed energy generated by a pellet shoot by an airgun is 12 joules. If the airgun is able to generate a bigger energy is considered as dangerous as a firearm, for so if you want to have a real powerfull airgun you have to have a firearms certificate.

You may not have a barrel length problem after all. I suggest you check the exact way it’s defined/measured. IIRC the procedure is to put a rod down the (unloaded) bore against the breech face, mark it at the muzzle end, remove it and measure. This would include the length of the factory tube.

For instance, I have a CAR-15 that uses the military sub gun barrel (10 1/2 inches IIRC) with a sleeve silver soldered on the end to bring the total to over 16 iches. The barrel is still only 10.5, but the gun is a legal rifle. There were a lot of these barrels on the surplus market some years back for very cheap, lots were modified and used this way.

Remember, the law really did have an intent other than making life tough on airgunners. The idea is to keep folks from making pistols out of rifles. It has to do with being easy to conceal, not the ballistics invovled. From the outisde the gun has a barrel in inch in diameter and over 16 inches long. If I recall the Fed regs on the matter, as it’s correctly measured.

It’s time to dig into the regs. It seems to me that your dealer, however well intentioned, is simply misinformed as to how the measurement is taken.

JM, to the Supreme Court you go! Call the NRA and see if they will take the case…or move!

The problem is local city laws will play a big role. Some towns have laws that say ” No airgun shooting is permitted in city limits” That’s how they get you. The NRA has tried to fight this one…and they had zero luck.

You should have Pyramid Air send you a SS with no barrel to the dealer and then send you the barrel to your house….lol
