Gun Expo Tradgedy, Accidental Death.

Father takes 8 year old son/s to a Machine gun Expo/Fun Shoot. Father let’s 8 year old son, Shoot a fully Automatic Uzi Sub machine gun. The boy shoots at a pumpkin and looses control of the Uzi and shoots himself in the head. The Uzi flips up all the way over to shoot backwards.

Now the local sheriff and the 2 Expo sponsors are being charged with manslaughter. No negligence charge against the Father. Who’s at fault here, would you let your 8 year old son shoot a full Auto handgun? Most adults can’t control a Full Automatic handgun! This is a tragedy, and shooter lacked proper training. Who’s responsible for a minor, and or his/her personal safety/gun safety? Wonder if they posted “Enter at Your Own Risk”?

Being a minor and not being responsible for his actions, why shouldn’t it fall to the parents/guardian? I think the shooter should be responsible, but being a minor, what do you think?

There are huge grey areas in the law and it s the officers job to interpret what has happend and take action or not possibly in a few seconds .

sometimes thier right sometimes theyre wrong , and man when thier wrong , the whole world knows it , and your job and legal action are on the line . Its not easy , not by a long shot .

I also belive that less laws are better for everyone , I dont like this fucking police state were moveing towards either

never said they were all bad HO, never even stated most were bad…
what I have said is that there are a small number of bad ones and the really awful part of it is that most of the good ones cover for the small number of true pricks in their midst.

in most of the really outrageous cases where an officer is held criminally accountable there always seems to have been several others that just stood idly by and watched the crime take place if not out right participated in the act but are never charged.

Totally agree Lama. Dad is ultimately responsible but Dad could have been an ignorant, clueless dumbass who knew little to nothing about guns or what they can do. Probably had seen them forever on TV and Movies and thought it would be cool to let his sons have a shot.

If I let someone shoot one of my guns I feel that I am responsible to make sure that they do it safely and will walk away with a good experience. Guys who hand a high powered firearm to someone they know have little to no experience shooting them and then poke their buddy in the ribs and say “watch this” deserve to have that shooter accidentally shoot the gun owner, several times.

IMO, the guy renting the gun is just as much at fault if not more for letting this happen.

in this case the parents had no real firearms background and were relying on the knowledge of the Range staff
who were only in it for money

I agree, it is the dad’s fault. It is tragic, but he was the one responsible for him.

Although, I definitely question the people who gave the kid the gun. I mean, it’s not like dad found it on the ground and handed it to the kid. He had to talk to someone who let the kid shoot it. It is ultimately dad’s fault, but if I was the one in charge of giving out guns, there is no way I’d let the kid shoot it.

So it’s the dad’s fault, but whoever was lending out guns definitely needs to sharpen up.

The father ultimately bears the responsibility for his minor son’s actions and activities. He, and he alone, bears the legal burden in this incident.

Further, he’ll pay for this for the rest of his life, whether he goes to jail or not. Most likely his marriage will suffer as well.

To charge the event coordinators with a crime can easily be done. Anger is obviously playing a part in this. However, the law makes it clear that it must be proven beyond a reasonable doubt that those charged were a direct contributor in the death in mention. Further, it must be shown that they failed to exercise a common law duty to provide for the safety of the participants, such as controlled environment, safe weapon handling, experts on site to supervise the shoot, and more than a little responsibility rests on exactly to whom they initially handed the loaded weapon. Once the father assumed physical control of the firearm, he became the primary party liable for actions, both legal and civil, that resulted.

Thus, the ultimate responsibility fell to the parent to ensure his son had full control of a deadly weapon, up to and including holding the weapon with him, as any sane father would have done.

Granted the event coordinators will bear a civil liability for a wrongful death, failing to timely intervene when they saw what was about to happen, but that’s not a criminal charge. When cooler heads gain control, this will sort itself out.
